Reading a Miami pre-construction contract in 2026
Pre-construction contracts in Miami are not standardized. Two contracts on identical units in the same building can differ by 8-12% in effective price by the time the building delivers, simply because of how five specific clauses are written.
Pay closest attention to: (1) the price escalation clause and any cap on developer-side increases, (2) the assignment language, (3) the closing extension provisions, (4) the deposit refund triggers, and (5) the "developer's reserved rights" addendum, which is where most surprises live.
